TERMS AND CONDITIONS AGREEMENT

This website itagtravel.com.au facility is the Learron Pty Ltd the Trustee for the Learron Business Trust Trading as ITAG Travel Corporation ACN 617 780 748, (thereafter referred to as ITAG Travel Corporation). The following are the Terms and Conditions Agreement as detailed.

ITAG Travel Corporation is a member of the AFTA Accreditation Scheme (ATAS) #A14121.

As such all monies received from you will be placed into a Client account until dispersed to the suppliers of your travel arrangements. 

ITAG TRAVEL CORPORATION IS AN AGENT FOR ITS SUPPLIERS OF TRAVEL PRODUCT:

ITAG Travel Corporation acts as an agent on behalf of travel suppliers including airlines, accommodation providers, cruise lines, rental car companies, wholesalers and other travel suppliers and is governed by the Terms and Conditions of those suppliers. While every effort is made to ensure that travel products are delivered as promoted ITAG Travel Corporation does not guarantee that this will happen as ITAG Travel Corporation is simply a reseller of these products.

OFFERS:

All offers and promotions of services sold through ITAG Travel Corporation are subject to availability and all advertised promotions apply solely to new bookings. Offers can be withdrawn at any time and without notice.

DEPOSITS AND PAYMENTS:

At the time of booking ITAG Travel Corporation will require a $150 per person non-refundable deposit on top of the deposits required by suppliers for international bookings and $100 per person for Domestic bookings. This is to cover ITAG Travel Corporation for their time in the event you decide not to go ahead with the booking. Note that this extra deposit is part of the overall quote for your travel and not additional to it.

At the time of booking ITAG Travel Corporation will also outline the schedule of payments due to secure and finalise your booking. Failure to pay the deposits due to suppliers by the due date may result in your booking being cancelled – suppliers often do this automatically so it is not something ITAG Travel Corporation can stop. While ITAG Travel Corporation can rebook the itinerary for you please note that the original dates requested may not still be available and that the price may have changed.

Failure to meet final payment deadlines can also lead to cancellation of your booking and any refund of the deposit monies you may have paid will be subject to the suppliers Terms and

CONDITIONS:

Once you have paid any money towards a booking it is deemed that you have read and understood theses Terms and Conditions.

Card payments will incur extra fees – 2% for Amex or Diners and 1.25% for Visa or MasterCard.

If a supplier fails to provide the product purchased your remedy lies against the supplier and not against ITAG Travel Corporation.

International travel arrangements are generally paid to the supplier in their local or nominated currency. Where prices are quoted to you in Australian Dollars then these are based on the exchange rate on the but note that there can be fluctuations in the final price due based on movements in the foreign exchange rates. The quoted price in Australian Dollars will be honoured were you have paid the full amount at the time of receiving the quote. Suppliers can also impose extra charges prior to your making the final payment and ITAG Travel Corporation is not liable if such changes occur. Rates quoted are correct at the time of booking and are subject to change with or without notice.

ITAG Travel Corporation is registered for GST and this tax applies to all domestic travel booked as part of your itinerary.

CONFIRMATIONS AND DOCUMENTATION:

Once you have booked your travel itinerary ITAG Travel Corporation will send you a written confirmation but note that bookings are not deemed to be finalised until all monies have been paid. Final documentation will not be issued by travel suppliers until they have received full payment for their part of your itinerary. Also note that each supplier will have their own terms on deposits and final payments and their own overall Terms and Conditions which govern their part of your itinerary.

On receipt of your travel documents you must check that they correctly reflect the booking you made so that any amendments can be made in good time and avoid any disruption to your travels. Equally you must provide passenger names exactly as they appear in your passports – you may be refused boarding by a cruise line or airline if the name on your booking is different to the one in your passport. Also be aware of any changes to your circumstances – such as having a new baby that needs to be registered on your passport or to have their own passport.

All passengers departing Australia must be in possession of a valid passport with a minimum of 6 month’s validity beyond your return date to Australia. ITAG Travel Corporation requires a copy of your passport prior to making final bookings and you must advise us if you are travelling on a non-Australian passport as this can affect your visa requirements to visit the countries in your itinerary and can also affect your right to return to Australia.

Please check your itinerary carefully before booking it as any changes to an itinerary will incur a fee of $60 per person by ITAG Travel Corporation for their time to make these changes plus the supplier may also charge change fees. These will be advised before any change is made. Where the change is as a result of the travel supplier’s actions you may be able to cancel or rebook without penalty but note that cruise lines and airlines both reserve the right to vary their schedules so your rights to cancel and /or rebook are subject to the suppliers Terms and Conditions.

Equally in the event you need to cancel a booking then any refunds due to you will be subject to the supplier’s terms and conditions.

Note that any packages specifically put together by ITAG Travel Corporation to attend key religious festivals such as the Hajj (i.e. not bought via a third party) are guaranteed by ITAG Travel Corporation.

 VISAS:

Many countries require visitors to have obtained a Visa for entry prior to arrival and it is your responsibility to ensure that you have valid passports, visas and entry permits. Any cost associated with not having correct documentation is solely your responsibility. ITAG Travel Corporation can source information on Visa requirements for you from a third party advisory service but we take no responsibility on the accuracy of their information.

Note if you are travelling to the USA they have a compulsory Visa Waiver program and you need to apply online at https://esta.cbp.dhs.gov Be aware that not all people will be eligible to participate in the Visa Waiver scheme in which case you would need to apply for entry clearance from the US Embassy prior to your arrival into the USA.

HEALTH AND SAFETY AND INSURANCE:

Check with your Doctor about any requirements for vaccinations. Check with DFAT via their www.smarttraveller.gov.au site for any travel advisories that may impact your itinerary

NB – Please ensure that if you do not buy the offered Travel Insurance from ITAG Travel Corporation that you have your own comprehensive travel insurance organised. This insurance should cover all aspects of the travel purchased as well as providing medical coverage while overseas including repatriation to Australia.

LIABILITY:

ITAG Travel Corporation cannot accept any responsibility for any act, omission or default (negligent or otherwise) of any travel service provider in connection with your holiday over whom ITAG Travel Corporation has no direct or exclusive control and we shall not be liable for any injury, loss or damage including consequential damage arising out of or connected to your travel booking.

We act as an agent for travel suppliers and have no responsibility for the provision of those services nor do we warrant regarding the standard of the services to be provided. Your recourse is against the specific travel provider and not against ITAG Travel Corporation.

PRIVACY:

ITAG Travel Corporation respects your privacy and all details collected by you will be used solely for the travel being booked and for the purposes of obtaining feedback from you or for advising you of special offers from time to time. If you do not wish to receive such notifications simply advise ITAG Travel Corporation – refer Privacy Statement.

SCHEDULE OF FEES:

• ITAG Travel Corporation will collect a non-refundable deposit per person in addition to any deposits required by the travel providers. This will be $150 per person for International travel and $100 per person for domestic travel. Note this deposit is not an addition to the quoted cost of your itinerary.
• Credit card service fees will be charged – 2% for Amex/Diners and 1.5% for Visa/MasterCard
• Booking fees maybe charged as determined by ITAG Travel Corporation, these will be advised before you proceed with a booking.
• Amendments to bookings will attract a charge of $60 per person per change.
• Arranging Visas has a fee of $75 per visa in addition to any fees charged by the relevant consulate or embassy and any costs for postage or couriers to deliver the documentation.
• No cash refunds will be given
• Cheque payments can only be accepted more than 10 days before final payments are due.
• Where ITAG Travel Corporation has to provide documentation to support an insurance claim and the insurance was not bought through ITAG Travel Corporation then a $100 fee will apply.

ABOUT THE ITAG TRAVEL CORPORATION WEBSITE:
ITAG Travel Corporation may use a customer IP address to administer the website for statistical, commercial and marketing purposes, and to create a database. We also may also use cookies to store the user’s name and password for future visits to the website. Various on-line processes may require users to provide us contact information e.g. name, business information, e-mail address etc. We use client contact information for commercial and marketing reasons such as contacting a user or you as necessary.

You have the ability to enter into electronic transactions directly with ITAG Travel Corporation and/or certain parties whose content appears on the site. You acknowledge that third parties provide some of the material accessible through the facility, and ITAG Travel Corporation is not responsible for this material. This site may contain links to other sites. ITAG Travel Corporation is not responsible for the legal or privacy practices or the content of such websites.

ITAG Travel Corporation may make alterations or additions to our Policy and this Agreement from time to time. Should we do so, we will update the Policy/Agreement on our website. We require that all visitors and clients to this website agree to abide by our Privacy Statement as part of our Terms and Conditions of trade. This policy also applies to users of the ITAG Travel Corporation website who are not clients of ITAG Travel Corporation Privacy Statement.

ITAG Travel Corporation does not knowingly collect, use or market any information to children without seeking parental or a guardian’s consent. We also urge you to familiarise yourself with your legal responsibilities with regard to children and the internet

GENERAL PROVISIONS:
This Agreement is governed by the laws in force in Queensland, Australia. You irrevocably submit to the non-exclusive jurisdiction of the Courts of Queensland and Courts of Appeal in Australia from them and/or any relevant Tribunals for determining any dispute concerning this Agreement.

ITAG Travel Corporation may legally assign any of our rights and obligations under this Agreement at any time by giving you notice. Your use of this website and any on-line facilities such as inquires; requests or reservations are subject to the following terms and conditions. Your use of the website or any of its content signifies your acceptance of these Terms and Conditions:

1. Ownership, Copyright and Trade Marks
   All title, ownership rights and intellectual property rights, including copyright, rest with ITAG Travel Corporation, and any unauthorised use is strictly prohibited.

• Accuracy Of Information and Limitation of Liability
  ITAG Travel Corporation does not unconditionally endorse or recommend any particular third party represented on this website. ITAG Travel Corporation has taken steps to ensure that the content of this website, including all information and listings is correct, but it is subject to amendment at any time without notice.
• As a User of This Website, You Acknowledge and Accept That

5. Use of an On-Line Facility
   ITAG Travel Corporation accordingly accepts no responsibility or liability for any misunderstanding, error, loss, damage, or inconvenience whatsoever and howsoever caused in respect of any inquiry and/or request made through an on-line facility. You agree that you will carefully check, and correct any mistakes in, any inquiry and/or request that you make through an on-line facility.

• Use of Your Information
  As the user of this website and any service or facility, you agree and consent that ITAG Travel Corporation may use your contact information i.e. your name, e-mail and physical/postal address and/or other contact details, for commercial or marketing purposes either directly or indirectly connected with your request.

7. Indemnity
   As a condition of your use of this website you agree to indemnify ITAG Travel Corporation from and against any liability, damage or loss that ITAG Travel Corporation incurs or suffers as a result of any action, inaction or omission on your part.

• Your Responsibility

You must read the specific terms and conditions and convey all information set out in those terms and conditions to ITAG Travel Corporation and any other parties covered by any request you make. • Fees, Charges or Services
  Certain charges, fees and/or services displayed on the website may, or may not include Australian Goods and Services Taxes (GST) and/or any additional charges. Inquiries made through the website also constitute a request, and the correctness of this request in regards to abiding by the rules and regulations of ITAG Travel Corporation is the responsibility of you. ITAG Travel Corporation does not guarantee fees or charges quoted until a request is confirmed by ITAG Travel Corporation. 10. Credit Card Transactions
    Credit card transactions may incur merchant fees or service fees on certain services. If so, charges will be advised to you. ITAG Travel Corporation accepts no responsibility for any breaches of security or misrepresentation in relation to credit card transactions. It is your responsibility to inquire prior to payment in regard to these fees – see schedule of fees.
11. Liability
    ITAG Travel Corporation does not accept responsibility for any service or conditions that are incorrectly represented within this system. The data and services shown are provided in good faith and ‘as is’. ITAG Travel Corporation do not warrant the accuracy, completeness, or fitness for a particular purpose of any data or services provided and to the maximum extent permitted by any law disclaimer all implied warranties in connection with such data or services. In no event shall ITAG Travel Corporation be liable for any injury, loss, claim, damage or any incidental or consequential damages, including but not limited to lost profits or savings, arising out of or in any way connected with the use of any display within the website.
12. Terms of Business and/or Terms of Engagement
